This section applies only to a petition filed after June 30, 2013. A petition for incorporation may not be refiled within two (2) years after the date:

(1)the petition was denied under section 8(b)(2) of this chapter; or
(2)of the election at which a majority of voters voting on the public question vote "no" under section 8 of this chapter. [Pre-Local Government Recodification Citation: 18-3-1-8 part.] As added by Acts 1980, P.L.212, SEC.4. Amended by P.L.147-2013, SEC.6; P.L.5-2015, SEC.66.
