Text
(a)This section applies to a vacancy in the
office of mayor of a second class city not covered by section 1 of this
chapter.
(b)A vacancy shall be filled as follows:
(1)If the city has a deputy mayor, the deputy mayor assumes the
office for the remainder of the unexpired term.
(2)If the city does not have a deputy mayor, the city controller
assumes the office for the remainder of the unexpired term.
(3)If the city does not have a deputy mayor and the office of city
controller is vacant, the common council shall fill the vacancy at
a regular or special meeting.
(c)The city clerk shall give notice of the meeting required under
subsection (b)(3). Except as provided in subsection (d), the meeting
shall be held not later than thirty (30) days after the vacancy occurs.
