§ 3-12-11-16 — Impoundment of election materials
Indiana·Art. 12 ASCERTAINING RESULTS OF ELECTIONS·Ch. 11 Recount and Contest Procedures for Presidential
(a)Except as provided in subsection (b), the
state recount commission may by order impound and provide for the
protection of any election records or equipment described by IC 3-12-10-5(a).
(b)In a recount of an election for a legislative office, the state
recount commission shall by order impound and provide for the
protection of the following:
(1)All ballots, and electronic voting systems used at the election
for casting votes in all of the precincts within the legislative
district.
(2)All tally sheets relating to the votes cast for the office.
(3)All poll lists of persons registered by the poll clerks as having
voted for the office.
