Text
Unless the contractor or the surety on the contractor’s bond shall appear and in good faith
proceed to comply with the demand, and resume work under the contract within the time
fixed, the board shall proceed to let contracts for the unfinished work in the same manner
as original contracts, and apply all funds not paid to the original contractor toward the
completion of the work, and if not sufficient for such purpose, may cause suit to be brought
upon the bond of the defaulting contractor for the benefit of the district, and the amount of
recovery thereon shall be credited to the district.
