Text
If the department finds that an emergency exists involving radioactive material or
radiation machines that requires immediate action to protect the public health and safety, the
department may, without notice or hearing, issue an order stating that an emergency exists
and requiring that action be taken as necessary to meet the emergency. An emergency order
shall be effective immediately. A person to whom the order is directed shall comply with the
orderimmediately, butonapplicationtothedepartmentshallbeaffordedahearingwithinten
days of the date application is made. The emergency order may be continued, modified, or
revoked within thirty days after the hearing, based on the evidence presented at the hearing.
