§ 31-40j — Definitions.

As used in sections 31-40j to 31-40p, inclusive:

(1)“Person” means one or more individuals, partnerships, associations, corporations, limited liability companies, business trusts, legal representatives or any organized group of persons.
(2)“Employer” means a person engaged in business who has employees, including the state and any political subdivision thereof.
(3)“Employee” means any person who may be exposed under normal operating conditions or foreseeable emergencies to toxic substances while engaged in service to an employer in a business of his employer. For the purposes of this subdivision, “emergency” means any occurrence such as, but not limited to, equipment failure, rupture of containers or failure of control equipment which may or does result in an uncontrolled release of a t
