(1)Any employer who violates the provisions of section 8-4-103 (6) commits:

(a)A petty offense if the amount is less than three hundred dollars;

(b)A class 2 misdemeanor if the amount is three hundred dollars or more but less than one thousand dollars;

(c)A class 1 misdemeanor if the amount is one thousand dollars or more but less than two thousand dollars;

(d)A class 6 felony if the amount is two thousand dollars or more but less than five thousand dollars;

(e)A class 5 felony if the amount is five thousand dollars or more but less than twenty thousand dollars;

(f)A class 4 felony if the amount is twenty thousand dollars or more but less than one hundred thousand dollars;

(g)A class 3 felony if the amount is one hundred thousand dollars or more but less than one mill

(1) Any employer who violates the provisions of
section 8-4-103 (6) commits:

(b) A class 2 misdemeanor if the amount is three hundred dollars or more but

(e) A class 5 felony if the amount is five thousand dollars or more but less

(f) A class 4 felony if the amount is twenty thousand dollars or more but less
than one hundred thousand dollars;

(g) A class 3 felony if the amount is one hundred thousand dollars or more
but less than one million dollars; and

(h) A class 2 felony if the amount is one million dollars or more.

(2) In addition to any other penalty imposed by this article 4, any employer or
agent of an employer who willfully refuses to pay wages or compensation as
provided in this article 4, or falsely denies the amount of a wage claim, or the
validity thereof, or that the same is due, with intent to secure for himself, herself, or
another person any discount upon such indebtedness or any underpayment of such
indebtedness or with intent to annoy, harass, oppress, hinder, coerce, delay, or
defraud the person to whom such indebtedness is due, commits theft as defined in
section 18-4-401.
