§ 8-67-104 — Exclusions
(1)The following persons may not recover
compensation or other benefits from the fund:
(a)A partner in a partnership or an owner of a sole proprietorship;
(b)A director or officer of a corporation;
(c)A member or manager of a limited liability company;
(d)An individual who was responsible for obtaining and maintaining the
employer's workers' compensation insurance coverage and who failed to do so;
(e)An individual who was eligible to be covered under a workers'
compensation insurance policy and voluntarily rejected the coverage under section
8-41-202, 8-41-404 (4)(a)(V), or 8-41-404 (4)(a)(VI);
(f)An individual who is not an employee as defined in sections 8-40-202
and 8-40-301 or who is otherwise ineligible to receive benefits under articles 40 to
47 of this title 8.
