Text

(1)In any proceeding in this state in which an award of back pay is made, the employer shall pay any such award in full, subject to the provisions of subsection
(3)of this section.
(2)The person ordering an award of back pay shall notify the director of the division of unemployment insurance of the award within five days after the date of the order.
(3)If, during the period for which back pay is awarded, the recipient of the award has been receiving unemployment benefits pursuant to the provisions of articles 70 to 82 of this title, the entity ordering the award shall reduce the amount of the award by the amount of benefits the person received, and the employer shall withhold that amount from the award.
