HELEN ELAINE WEST, Plaintiff, 23-CV-2256 (LTS) -against- ORDER THE CITY OF NEW YORK, et al., Defendants. LAURA TAYLOR SWAIN, Chief United States District Judge: Plaintiff filed this action pro se. On May 30, 2023, the Court held that Plaintiff’s complaint failed to state a claim on which relief may be granted and granted her leave to file an amended complaint within 60 days. On August 1, 2023, Plaintiff filed a request to extend the time to amend her complaint until September 24, 2023. The Court grants Plaintiff’s request. CONCLUSION Plaintiff’s request for an extension of time is granted. If Plaintiff chooses to file an amended complaint, as described in the May 30, 2023, order to amend, she must do so on or before September 24, 2023. An amended complaint form is attached to this order. If Plaintiff does not file an amended complaint, the complaint will be dismissed for failure to state a claim upon which relief may be granted. The Court certifies under 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal.
