Text
When anyone has applied excess water to beneficial use, as
herein provided, he shall be entitled thereafter to divert and
beneficially use his proportionate share thereof, and the
diversion and beneficial use, when accomplished, is hereby
declared to be an appropriation of the water, entitled to a
priority senior to any water right acquired after March 1, 1985.
The provisions of W.S. 41-4-321 through 41-4-324 shall apply to
excess water in the same manner as it does to surplus water,
except that excess water shall, pursuant to W.S. 41-4-323, have
a priority date of March 1, 1985. The term "surplus" in W.S.
41-4-324 shall apply to excess water under this act.
