Text
It shall be the duty of the state engineer, water
superintendents and water commissioners and their assistants to
divide, regulate and control the diversion and taking of surplus
water from any stream in a manner that all applicants will be
able to obtain a proportionate share, as hereinafter defined, of
the surplus water.
