(a) Authorization is granted for the Level III new
development construction projects identified in this section
subject to the general conditions specified in W.S. 99-3-103.

(b) Project – Arapahoe Water Supply 2016:
(i) Project sponsor: Northern Arapaho Indian Tribe;
(ii) Project purpose: Rural domestic water supply;
(iii) Project description: Design and construction of
transmission pipelines and appurtenances necessary to make the
project function in the manner intended;
(iv) Total project budget: Three million three
hundred fifty-five thousand dollars ($3,355,000.00);
(v) Project grant: The state of Wyoming shall grant
to the sponsor from water development account I through the
commission for the design, permit procurement, project land
procurement, construction engineering and construction of the
project an amount not to exceed two million two hundred
forty-seven thousand eight hundred fifty dollars ($2,247,850.00)
or sixty-seven percent (67%) of the actual development costs,
whichever is less;
(vi) Appropriation: There is appropriated from water
development account I to the commission two million two hundred
forty-seven thousand eight hundred fifty dollars ($2,247,850.00)
or as much thereof as is necessary to carry out the purpose of
this subsection. Unexpended funds appropriated under this
subsection shall revert to water development account I on July
1, 2026.
(vii) Special conditions: The sponsor is responsible
for acquiring thirty-three percent (33%) of the total project

(c) Project – Buffalo Main Street Pipeline:
(i) Project sponsor: City of Buffalo;
(ii) Project purpose: Municipal, rural domestic water
supply;
(iii) Project description: Design and construction of
a transmission pipeline and appurtenances necessary to make the
project function in the manner intended;
(iv) Total project budget: Two hundred thirty
thousand dollars ($230,000.00);
(v) Project grant: The state of Wyoming shall grant
to the sponsor from water development account I through the
commission for the design, permit procurement, project land
procurement, construction engineering and construction of the
project an amount not to exceed one hundred fifty-four thousand
one hundred dollars ($154,100.00) or sixty-seven percent (67%)
of the actual development costs, whichever is less;
(vi) Appropriation: There is appropriated from water
development account I to the commission one hundred fifty-four
thousand one hundred dollars ($154,100.00) or as much thereof as
is necessary to carry out the purpose of this subsection.
Unexpended funds appropriated under this subsection shall revert
to water development account I on July 1, 2021;
(vii) Special conditions: The sponsor is responsible
for acquiring thirty-three percent (33%) of the total project
budget from other sources.

(d) Project – Buffalo Tank Valve:
(i) Project sponsor: City of Buffalo;
(ii) Project purpose: Municipal, rural domestic water
supply;
(iii) Project description: Design and construction of
valves, pipelines and appurtenances necessary to make the
project function in the manner intended;
(iv) Total project budget: One hundred seventy-five
thousand dollars ($175,000.00);
(v) Project grant: The state of Wyoming shall grant
to the sponsor from water development account I through the
commission for the design, permit procurement, project land
procurement, construction engineering and construction of the
project an amount not to exceed one hundred seventeen thousand
two hundred fifty dollars ($117,250.00) or sixty-seven percent
(67%) of the actual development costs, whichever is less;
(vi) Appropriation: There is appropriated from water
development account I to the commission one hundred seventeen
thousand two hundred fifty dollars ($117,250.00) or as much
thereof as is necessary to carry out the purpose of this
subsection. Unexpended funds appropriated under this subsection
shall revert to water development account I on July 1, 2021;
(vii) Special conditions: The sponsor is responsible
for acquiring thirty-three percent (33%) of the total project
budget from other sources.

(e) Project – Deaver Transmission Pipeline:
(i) Project sponsor: Town of Deaver;
(ii) Project purpose: Municipal, rural domestic water
supply;
(iii) Project description: Design and construction of
a transmission pipeline and appurtenances necessary to make the
project function in the manner intended;
(iv) Total project budget: One million one hundred
fifty thousand dollars ($1,150,000.00);
(v) Project grant: The state of Wyoming shall grant
to the sponsor from water development account I through the
commission for the design, permit procurement, project land
procurement, construction engineering and construction of the
project an amount not to exceed seven hundred seventy thousand
five hundred dollars ($770,500.00) or sixty-seven percent (67%)
of the actual development costs, whichever is less;
(vi) Appropriation: There is appropriated from water
development account I to the commission seven hundred seventy
thousand five hundred dollars ($770,500.00) or as much thereof
as is necessary to carry out the purpose of this subsection.
Unexpended funds appropriated under this subsection shall revert
to water development account I on July 1, 2021;
(vii) Special conditions: The sponsor is responsible
for acquiring thirty-three percent (33%) of the total project
budget from other sources.

(f) Project – Dubois Well Acquisition:
(i) Project sponsor: Town of Dubois;
(ii) Project purpose: Municipal, rural domestic water
supply;
(iii) Project description: Purchase of an existing
groundwater well currently owned by the commission;
(iv) Total project budget: Zero dollars ($0.00);
(v) Appropriation: The appropriation for this project
is zero dollars ($0.00). The authorization approving the sale of
this well shall expire on July 1, 2017;
(vi) Special conditions:
(A) The sponsor is responsible for acquiring one
hundred percent (100%) of the total well purchase from other
sources;
(B) The sponsor shall purchase the well drilled
during the level II study for a price not to exceed thirty-three
percent (33%) of the well's actual construction costs. The
sponsor shall purchase the well with a lump sum payment.

(g) Project – Gillette Regional Extensions-Phase II:
(i) Project sponsor: City of Gillette;
(ii) Project purpose: Municipal, rural domestic water
supply;
(iii) Project description: Design and construction of
pipelines and appurtenances necessary to make the project
function in the manner intended;
(iv) Total project budget: Three million three
hundred forty thousand dollars ($3,340,000.00);
(v) Project grant: The state of Wyoming shall grant
to the sponsor from water development account I through the
commission for the design, permit procurement, project land
procurement, construction engineering and construction of the
project an amount not to exceed two million two hundred
thirty-seven thousand eight hundred dollars ($2,237,800.00) or
sixty-seven percent (67%) of the actual development costs,
whichever is less;
(vi) Appropriation: There is appropriated from water
development account I to the commission two million two hundred
thirty-seven thousand eight hundred dollars ($2,237,800.00) or
as much thereof as is necessary to carry out the purpose of this
subsection. Unexpended funds appropriated under this subsection
shall revert to water development account I on July 1, 2021;
(vii) Special conditions: The sponsor is responsible
for acquiring thirty-three percent (33%) of the total project

(h) Project – Greybull Transmission Pipeline:
(i) Project sponsor: Town of Greybull;
(ii) Project purpose: Municipal, rural domestic water
supply;
(iii) Project description: Design and construction of
a transmission pipeline and appurtenances necessary to make the
project function in the manner intended;
(iv) Total project budget: One million two hundred
thirty thousand dollars ($1,230,000.00);
(v) Project grant: The state of Wyoming shall grant
to the sponsor from water development account I through the
commission for the design, permit procurement, project land
procurement, construction engineering and construction of the
project an amount not to exceed eight hundred twenty-four
thousand one hundred dollars ($824,100.00) or sixty-seven
percent (67%) of the actual development costs, whichever is
less;
(vi) Appropriation: There is appropriated from water
development account I to the commission eight hundred
twenty-four thousand one hundred dollars ($824,100.00) or as
much thereof as is necessary to carry out the purpose of this
subsection. Unexpended funds appropriated under this subsection
shall revert to water development account I on July 1, 2021;
(vii) Special conditions: The sponsor is responsible
for acquiring thirty-three percent (33%) of the total project
budget from other sources.

(j) Project – Kemmerer Transmission Pipeline 2016:
(i) Project sponsor: Kemmerer-Diamondville Joint
Powers Water Board;
(ii) Project purpose: Municipal, rural domestic water
supply;
(iii) Project description: Design and construction of
a transmission pipeline and appurtenances necessary to make the
project function in the manner intended;
(iv) Total project budget: One million seven hundred
fifty thousand dollars ($1,750,000.00);
(v) Project grant: The state of Wyoming shall grant
to the sponsor from water development account I through the
commission for the design, permit procurement, project land
procurement, construction engineering and construction of the
project an amount not to exceed one million one hundred
seventy-two thousand five hundred dollars ($1,172,500.00) or
sixty-seven percent (67%) of the actual development costs,
whichever is less;
(vi) Appropriation: There is appropriated from water
development account I to the commission one million one hundred
seventy-two thousand five hundred dollars ($1,172,500.00) or as
much thereof as is necessary to carry out the purpose of this
subsection. Unexpended funds appropriated under this subsection
shall revert to water development account I on July 1, 2021;
(vii) Special conditions: The sponsor is responsible
for acquiring thirty-three percent (33%) of the total project
budget from other sources.

(k) Project – Lander Transmission Pipeline 2016:
(i) Project sponsor: City of Lander;
(ii) Project purpose: Municipal and rural domestic
water supply;
(iii) Project description: Design and construction of
a transmission pipeline and appurtenances necessary to make the
project function in the manner intended;
(iv) Total project budget: Three million ninety-one
thousand dollars ($3,091,000.00);
(v) Project grant: The state of Wyoming shall grant
to the sponsor from water development account I through the
commission for the design, permit procurement, project land
procurement, construction engineering and construction of the
project an amount not to exceed two million seventy thousand
nine hundred seventy dollars ($2,070,970.00) or sixty-seven
percent (67%) of the actual development costs, whichever is
less;
(vi) Appropriation: There is appropriated from water
development account I to the commission two million seventy
thousand nine hundred seventy dollars ($2,070,970.00) or as much
thereof as is necessary to carry out the purpose of this
subsection. Unexpended funds appropriated under this subsection
shall revert to water development account I on July 1, 2021;
(vii) Special conditions: The sponsor is responsible
for acquiring thirty-three percent (33%) of the total project
budget from other sources.

(m) Project – Meeteetse Tank/SCADA/Retrofit:
(i) Project sponsor: Town of Meeteetse;
(ii) Project purpose: Municipal, rural domestic water
supply;
(iii) Project description: Design and construction of
a pipeline, valves, supervisory control and data acquisition
(SCADA) system upgrade and appurtenances necessary to make the
project function in the manner intended;
(iv) Total project budget: One hundred forty thousand
dollars ($140,000.00);
(v) Project grant: The state of Wyoming shall grant
to the sponsor from water development account I through the
commission for the design, permit procurement, project land
procurement, construction engineering and construction of the
project an amount not to exceed ninety-three thousand eight
hundred dollars ($93,800.00) or sixty-seven percent (67%) of the
actual development costs, whichever is less;
(vi) Appropriation: There is appropriated from water
development account I to the commission ninety-three thousand
eight hundred dollars ($93,800.00) or as much thereof as is
necessary to carry out the purpose of this subsection.
Unexpended funds appropriated under this subsection shall revert
to water development account I on July 1, 2021;
(vii) Special conditions: The sponsor is responsible
for acquiring thirty-three percent (33%) of the total project
budget from other sources.

(n) Project – Shoshone Transmission Pipeline 2016:
(i) Project sponsor: Shoshone Municipal Water Joint
Powers Board;
(ii) Project purpose: Municipal, rural domestic water
supply;
(iii) Project description: Design and construction of
a transmission pipeline and appurtenances necessary to make the
project function in the manner intended;
(iv) Total project budget: Six million seven hundred
fifty thousand dollars ($6,750,000.00);
(v) Project grant: The state of Wyoming shall grant
to the sponsor from water development account I through the
commission for the design, permit procurement, project land
procurement, construction engineering and construction of the
project an amount not to exceed two million two hundred
twenty-seven thousand five hundred dollars ($2,227,500.00) or
thirty-three percent (33%) of the actual development costs,
whichever is less;
(vi) Appropriation: There is appropriated from water
development account I to the commission two million two hundred
twenty-seven thousand five hundred dollars ($2,227,500.00) or as
much thereof as is necessary to carry out the purpose of this
subsection. Unexpended funds appropriated under this subsection
shall revert to water development account I on July 1, 2021;
(vii) Special conditions: The sponsor is responsible
for acquiring sixty-seven percent (67%) of the total project
budget from other sources.

(o) Project – South Big Horn County Pipeline:
(i) Project sponsor: South Big Horn County Rural
Water District;
(ii) Project purpose: Rural domestic water supply;
(iii) Project description: Design and construction of
a transmission pipeline and appurtenances necessary to make the
project function in the manner intended;
(iv) Total project budget: Five million three hundred
ten thousand dollars ($5,310,000.00);
(v) Project grant: The state of Wyoming shall grant
to the sponsor from water development account I through the
commission for the design, permit procurement, project land
procurement, construction engineering and construction of the
project an amount not to exceed three million five hundred
fifty-seven thousand seven hundred dollars ($3,557,700.00) or
sixty-seven percent (67%) of the actual development costs,
whichever is less;
(vi) Appropriation: There is appropriated from water
development account I to the commission three million five
hundred fifty-seven thousand seven hundred dollars
($3,557,700.00) or as much thereof as is necessary to carry out
the purpose of this subsection. Unexpended funds appropriated
under this subsection shall revert to water development account
I on July 1, 2021;
(vii) Special conditions: The sponsor is responsible
for acquiring thirty-three percent (33%) of the total project
budget from other sources.

(p) Project – Sundance PRV Improvements 2016:
(i) Project sponsor: Town of Sundance;
(ii) Project purpose: Municipal and rural domestic
water supply;
(iii) Project description: Design and construction of
pressure reducing valve (PRV) improvements and appurtenances
necessary to make the project function in the manner intended;
(iv) Total project budget: Two hundred five thousand
dollars ($205,000.00);
(v) Project grant: The state of Wyoming shall grant
to the sponsor from water development account I through the
commission for the design, permit procurement, project land
procurement, construction engineering and construction of the
project an amount not to exceed one hundred thirty-seven
thousand three hundred fifty dollars ($137,350.00) or
sixty-seven percent (67%) of the actual development costs,
whichever is less;
(vi) Appropriation: There is appropriated from water
development account I to the commission one hundred thirty-seven
thousand three hundred fifty dollars ($137,350.00) or as much
thereof as is necessary to carry out the purpose of this
subsection. Unexpended funds appropriated under this subsection
shall revert to water development account I on July 1, 2021;
(vii) Special conditions: The sponsor is responsible
for acquiring thirty-three percent (33%) of the total project
budget from other sources.

(q) Project – Sundance Transmission Pipeline 2016:
(i) Project sponsor: Town of Sundance;
(ii) Project purpose: Municipal, rural domestic water

project function in the manner intended;
(iv) Total project budget: One million sixty-five
thousand dollars ($1,065,000.00);
(v) Project grant: The state of Wyoming shall grant
to the sponsor from water development account I through the
commission for the design, permit procurement, project land
procurement, construction engineering and construction of the
project an amount not to exceed seven hundred thirteen thousand
five hundred fifty dollars ($713,550.00) or sixty-seven percent
(67%) of the actual development costs, whichever is less;
(vi) Appropriation: There is appropriated from water
development account I to the commission seven hundred thirteen
thousand five hundred fifty dollars ($713,550.00) or as much
thereof as is necessary to carry out the purpose of this
subsection. Unexpended funds appropriated under this subsection
shall revert to water development account I on July 1, 2021;
(vii) Special conditions: The sponsor is responsible
for acquiring thirty-three percent (33%) of the total project
budget from other sources.

(r) Project – Weather Modification Wind River Mountains
2017:
(i) Project sponsor: The state of Wyoming;
(ii) Project purpose: To enhance the winter snowpack
in the Wind River Mountain Range;
(iii) Project description: Conduct an operational
winter snowpack augmentation program during the 2016-2017 fall,
winter and spring seasons;
(iv) Total project budget: Six hundred ten thousand
dollars ($610,000.00);
(v) Appropriation: There is appropriated from water
development account I to the Wyoming water development office
one hundred sixty thousand dollars ($160,000.00) or as much
thereof as is necessary to carry out the purpose of this
subsection. Unexpended funds appropriated under this subsection
shall revert to water development account I on July 1, 2018;
(vi) Special conditions:
(A) The Wyoming water development office shall
manage and provide oversight of the program. Ten thousand
dollars ($10,000.00) of the total appropriation is allocated for
this purpose;
(B) The project operations budget shall not
exceed six hundred thousand dollars ($600,000.00) of which the
state of Wyoming shall participate at a rate of twenty-five
percent (25%) of actual project operations costs;
(C) Prior to commencing project operations, the
Wyoming water development office shall acquire funding
commitments from other Colorado River basin water users or other
interested parties for seventy-five percent (75%) of actual
project operations costs;
(D) If the state of Wyoming is unable to secure
adequate funding commitments and the project is cancelled, the
Wyoming water development office is authorized to use the
appropriated funds to remove weather modification equipment and
reclaim project sites.

(s) Project – Wheatland Pipelines:
(i) Project sponsor: Town of Wheatland;
(ii) Project purpose: Municipal, rural domestic water
supply;
(iii) Project description: Design and construction of
transmission pipeline and appurtenances necessary to make the
project function in the manner intended;
(iv) Total project budget: Seven hundred eighty
thousand dollars ($780,000.00);
(v) Project grant: The state of Wyoming shall grant
to the sponsor from water development account I through the
commission for the design, permit procurement, project land
procurement, construction engineering and construction of the
project an amount not to exceed five hundred twenty-two thousand
six hundred dollars ($522,600.00) or sixty-seven percent (67%)
of the actual development costs, whichever is less;
(vi) Appropriation: There is appropriated from water
development account I to the commission five hundred twenty-two
thousand six hundred dollars ($522,600.00) or as much thereof as
is necessary to carry out the purpose of this subsection.
Unexpended funds appropriated under this subsection shall revert
to water development account I on July 1, 2021;
(vii) Special conditions: The sponsor is responsible
for acquiring thirty-three percent (33%) of the total project
budget from other sources.
