Text
(a)The director shall issue a written decision approving
or disapproving the application.
(b)The director may condition approval on a modification
of all or part of the proposed arrangement to eliminate any
restriction on competition that is not reasonably related to the
goals of reducing cost or improving access or quality. The
director may also establish conditions for approval that are
reasonably necessary to protect against abuses of private
economic power and to ensure that the arrangement is
appropriately supervised and regulated by the state.
(c)The decision by the director approving or disapproving
an application shall include specific findings of fact
concerning cost, access and quality criteria and shall identify
one (1) or more of these criteria as the basis for the decision.
