Text
At the direction of the state, in the case of a person sentenced
to the custody of the department of corrections to serve a term
of imprisonment in a state penal institution, or at the
direction of the local government in the case of a person
sentenced to imprisonment in a city or county jail, the person
sentenced to imprisonment may be incarcerated in a facility
constructed or operated by a private entity pursuant to a
contract under this article.
