Text
(a)The department of health or the department of family
services may petition any district court in the state to be
appointed guardian of a minor who is in its custody.
(b)If a department in subsection (a) of this section is
not the petitioner in a proceeding to appoint a guardian for a
ward in its custody, it shall not be appointed guardian unless
given prior notice and opportunity for hearing.
