Text
(1)An environmental covenant may be amended or terminated by consent only if the amendment or termination is signed by:
(1)(a) the agency;
(1)(b) unless waived by the agency, the current owner of the fee simple of the real property subject to the covenant;
(1)(c) each person that originally signed the covenant, unless:
(1)(c)(i) the person waived in a signed record the right to consent;
(1)(c)(ii) the executive director of the Department of Environmental Quality finds that the person:
(1)(c)(ii)(A) no longer exists;
(1)(c)(ii)(B) is not legally competent to sign the amendment or termination; or
(1)(c)(ii)(C) cannot be located or identified with the exercise of reasonable diligence; or
(1)(c)(iii) a court finds that the person no longer exists or cannot be located or identified with the
