Sec. 257.106. ORDER OF ELECTION TO ESTABLISH DISTRICT.

(a)The commissioners court of each county included in whole or part in a proposed road district may issue and record in its minutes an order directing that an election be held within the county or the defined portion of the county if on the hearing of the petition to establish the district the court finds that:
(1)the petition is signed by the required number of registered voters of the county or defined portion of the county;
(2)notice of the hearing was given as required by law; and
(3)the establishment of the proposed district by the consolidation of the county or defined portion of the county with the other counties or defined portions of counties named in the proceedings would be for the benefit of all taxable property in the
