§ 46-5-7. Late filing of petition for jury trial.
The court may, in its discretion, permit the filing of the petition subsequent to
            one year from the filing of the description, plat, and statement, unless the petitioner
            therein has had actual notice of the taking of the land in which the petitioner claims
            an interest in season to have filed his or her petition within the year, and unless
            the state has then paid some other person for the estate or interest or become liable
            to pay for the estate or interest under a judgment rendered against the state under
            the provisions of this chapter.
