§ 23-39-12. Denial, suspension, revocation, and reinstatement of licenses.
The board may refuse to issue or may suspend or revoke any license in accordance with
the procedures set forth in the Administrative Procedures Act, chapter 35 of title 42, for any of the following causes:
(1) Fraud in the procurement of any license under this chapter;
(2) Imposition of any disciplinary action upon a person by any agency of another state
which regulates respiratory care but not to exceed the period or extent of that action;
(3) Conviction of a crime which substa

or duties of a respiratory care practitioner. The record of conviction or a certified
copy thereof shall be conclusive evidence of the conviction;
(4) Impersonating or acting as a proxy for an applicant in any examination given under
this chapter;
(5) Habitual or excessive use of intoxicants or drugs;
(6) Gross negligence in his or her practice as a respiratory care practitioner;
(7) Violating any of the provisions of this chapter or any rules or regulations duly adopted
under this chapter or aiding or abetting any person to violate the provisions of or
any rules or regulations adopted under this chapter;
(8) Engaging in acts of unprofessional conduct as defined by rule and regulation; or
(9) Committing any fraudulent, dishonest or corrupt act which is substantially related
to the qualifications, functions, or duties of a respiratory care practitioner.
