§ 23-17.29-12. Liability.

(a) The mere presence of an electronic monitoring device in a resident's room or private living unit is not a violation of the resident's right to privacy under § 23-17.5-14.

(b) A facility or home care provider is not civilly or criminally liable for the inadvertent or unintentional disclosure of a recording by a resident or a resident representative for any purpose not authorized by this chapter.
