bus turn-arounds. In order to protect the health, safety and welfare of the children of this state, the board of county commissioners shall be authorized to enter onto private property adjoining county roads in order to perform maintenance or improvements to an existing private road when: 1. The private road is used by a school bus to turn around; 2. The available right-of-way does not provide enough space for the school bus to turn around without endangering the occupants of the school bus; and 3. The owner of the private road agrees in writing to the necessary maintenance or improvements. The maintenance or improvements to the private road shall be limited to the area necessary for the school bus to adequately turn around.
