Text

A public trust created under the terms of this act shall have the power to condemn property in like manner as railroad companies for purposes consistent with the intent of this act. Provided that before any action for condemnation shall be instituted by such public trust, there shall have been a contract entered into for the construction of the toll expressway and a performance bond shall have been posted with the trustees in an amount equal to the estimated cost of labor and materials, and the trustees shall investigate and be assured on reasonable evidence that the contractor or such other party who is to participate in all or a portion of the cost of acquiring rights-of-way is financially able and has committed in writing to the payment for a portion or all of the estimated cost of acqu
