Text
In no case shall it be considered as negligence on the part of the owner or occupant of property injured by fire as provided by section4963.37of the Revised Code, that he used or permitted it to be used and remain as if no railroad passed through or near such property. This section does not apply in cases of injury by fire to personalty which at the time was on the property occupied by such railroad.
