If the underground technical committee reports that a person responsible for a compliance failure has been found to be a persistent noncomplier under section4913.17of the Revised Code, the public utilities commission may impose a fine on the person not exceeding ten thousand dollars. A penalty recommended by the committee under section4913.15or4913.16of the Revised Code may also be imposed by the commission.
