§ 4799.04 — State or local licenses not required for certain disaster work

(A) As used in this section, "critical infrastructure," "disaster response period," "disaster work," "out-of-state disaster business," and " qualifying employee" have the same meanings as in section5703.94of the Revised Code.

(B) No out-of-state disaster business or qualifying employee shall be required to obtain a state or local license or other authorization to engage in an occupation in this state for an activity for which a license or other authorization is required under Title XLVII of the Revised Code, local ordinance, or other provision of state or local law, rule, or regulation if any of the following are true:

(1) The activity is disaster work performed in this state by an out-of-state disaster business during a disaster response period pursuant to a qualifying solicitation received by the business.

(2) The activity is disaster work performed in this state by a qualifying employee described in division (A)(14)(a) of section5703.94of the Revised Code during a disaster response period pursuant to a qualifying solicitation received by the employee's employer.

(3) The activity is disaster work performed in this state by a qualifying employee described in division (A)(14)(b) of section5703.94of the Revised Code during a disaster response period on critical infrastructure owned or used by the employee's employer.

(C)(1) Upon request by the secretary of state, the employer of each qualifying employee who performed disaster work in this state during the disaster response period shall provide proof of the employee's eligibility to perform t he disaster work as determined by the employer's books and records.

(2) If the secretary makes a request under division (C)(1) of this section, the employer shall submit information described in that division to the secretary not later than thirty days from the date the disaster response period terminates or thirty days from the date the employer receives the request, whichever is later.
