Text

(A)If the director of environmental protection determines that conditions at a reporting facility constitute an imminent and substantial threat to public health or safety or are causing or contributing to, or are threatening to cause or contribute to, air or water pollution or soil contamination, the director may expend moneys from the immediate removal fund created in section3745.12of the Revised Code to take such remedial actions as are necessary or appropriate to protect the public health or safety or the environment, provided that a violation or failure to comply with any of the following has occurred or is occuring at the facility:
(1)Section3752.06of the Revised Code, a rule adopted under section3752.03of the Revised Code implementing that section, or a term or condition of an ord
