(A)If the holder of a mortgage or fiduciary fails to undertake the actions required under division (B) of section3752.11or of section3752.111of the Revised Code, respectively, the director of environmental protection, on behalf of the state, or any political subdivision in which the affected reporting facility is located may undertake the actions required under division (B) of either of those sections. The costs so incurred by the director or the political subdivision shall be recoverable as a civil penalty under division (C) of section3752.17of the Revised Code.

(B)If, after receiving notice under division (C) of section3752.11or of section3752.111of the Revised Code, the director or the political subdivision in which the affected reporting facility is located determines that the facil

(A) If the holder of a mortgage or fiduciary fails to undertake the actions required under division (B) of section3752.11or of section3752.111of the Revised Code, respectively, the director of environmental protection, on behalf of the state, or any political subdivision in which the affected reporting facility is located may undertake the actions required under division (B) of either of those sections. (B) If, after receiving notice under division (C) of section3752.11or of section3752.111of the Revised Code, the director or the political subdivision in which the affected reporting facility is located determines that the facility should continue to be secured against unauthorized entry, the director or the political subdivision may undertake any of the actions specified in division (B)(1) of section3752.11or division (B) of section3752.111of the Revised Code. The costs so incurred are a lien upon the facility. The director or the appropriate official of the political subdivision shall prepare and present for recording in the office of the county recorder of the county in which the facility is located notice of the lien. The county recorder shall not charge a fee for recording a notice of lien under this division.
