Text

(A)If the holder of a mortgage or fiduciary fails to undertake the actions required under division (B) of section3752.11or of section3752.111of the Revised Code, respectively, the director of environmental protection, on behalf of the state, or any political subdivision in which the affected reporting facility is located may undertake the actions required under division (B) of either of those sections. The costs so incurred by the director or the political subdivision shall be recoverable as a civil penalty under division (C) of section3752.17of the Revised Code.
(B)If, after receiving notice under division (C) of section3752.11or of section3752.111of the Revised Code, the director or the political subdivision in which the affected reporting facility is located determines that the facil
