§ 2123 — Exclusiveness of procedure

* § 2123. Exclusiveness of procedure. The method provided in this\narticle of perfecting and giving notice of security interests subject to\nthis article is exclusive. Security interests subject to this article\nare hereby exempted from the provisions of law which otherwise relate to\nthe perfection of security interests, including but not limited to\nsection 9-313 of the uniform commercial code.\n * NB Effective until December 12, 2026\n * § 2123. Security interests subject to this article\nare hereby exempted from the provisions of law which otherwise relate to\nthe perfection of security interests, provided, however, that with\nrespect to a manufactured home that is or will be affixed to a permanent\nfoundation, upon recordation of an affidavit of affixation pursuant to\nparagraph (iii) of subdivision (a) of section three hundred forty-four-b\nof the real property law and satisfaction of the requirements of section\ntwenty-one hundred seventeen-a, twenty-one hundred seventeen-b or\ntwenty-one hundred seventeen-c of this article, any perfection or\ntermination of a security interest with respect to such manufactured\nhome shall conform to the requirements of article nine-E of the real\nproperty law.\n * NB Effective December 12, 2026\n
