§ 400. Method of commencing action or special proceeding.\n Section three hundred four of the civil practice law and rules shall\nnot apply in this court. An action is commenced in this court and\njurisdiction acquired by service of a summons. A special proceeding is\ncommenced and jurisdiction acquired by service of a notice of petition\nor order to show cause.\n
