§ 97-y. Business and licensing services account. 1. There is hereby\nestablished within the miscellaneous special revenue fund in the joint\ncustody of the state comptroller and the commissioner of taxation and\nfinance an account to be known as the "business and licensing services\naccount".\n 2. The business and licensing services account shall consist of all\nmonies collected by the department of state from:
(a)fees paid to it in\nconjunction with its activities pursuant to the business corporation\nlaw, the not-for-profit corporation law, or other corporate law, the\npartnership law, the limited liability company law, and correlative\nprovisions of the executive law, the general business law and any other\nlaw, consolidated or unconsolidated;

The business and licensing services account shall consist of all\nmonies collected by the department of state from: (a) fees paid to it in\nconjunction with its activities pursuant to the business corporation\nlaw, the not-for-profit corporation law, or other corporate law, the\npartnership law, the limited liability company law, and correlative\nprovisions of the executive law, the general business law and any other\nlaw, consolidated or unconsolidated; (b) fees paid to it in conjunction\nwith its activities pursuant to the provisions of section ninety-six-a\nof the executive law or pursuant to any other provision of law, for\nservices rendered in accordance with the provisions of the uniform\ncommercial code or article ten-A of the lien law; (c) fees charged for\nthe regulation, licensing, examination, certification, registration and\ndiscipline activities of the department of state; (d) monies received\nfrom licenses granted under section four hundred thirty-eight of the\njudiciary law; and (e) fees collected pursuant to section three hundred\nninety-nine-pp of the general business law.\n 3. Monies within the business and licensing services account, upon\nappropriation by the legislature, shall be available to the department\nof state for the operation of the department in relation to (a) uniform\ncommercial code and related tax lien requirements, (b) corporations and\nstate records functions and services, including but not limited to\nreviewing, filing, searching, certifying or copying of documents,\ninstruments and records rendered by the department in conjunction\ntherewith, (c) the regulation, licensing, examination, certification,\nregistration and discipline activities of the department of state, and\n(d) implementation, operation and enforcement of articles seven-A,\neight-B and eight-C of the general business law.\n 4. Notwithstanding any other provisions of this section to the\ncontrary, moneys deposited pursuant to sections ninety-seven-r and\nninety-seven-nn of this article shall be available to the department of\nstate for the purposes set forth in such sections.\n
