1.There is hereby established in the joint custody of\nthe commissioner of taxation and finance and the comptroller, a special\nfund to be known as the "leukemia, lymphoma and myeloma research,\neducation and treatment fund".\n 2. Such fund shall consist of all revenues received by the department\nof taxation and finance, pursuant to the provisions of section two\nhundred nine-M and section six hundred thirty-g of the tax law and all\nother moneys appropriated, credited, or transferred thereto from any\nother fund or source pursuant to law. On or before the first day of February each year, the\ncommissioner of health shall provide a written report to the temporary\npresident of the senate, the speaker of the assembly, the chair of the\nsenate finance committee, the chair of the assembly ways and means\ncommittee, the chair of the senate committee on health, the chair of the\nassembly health committee, the state comptroller and the public. Such\nreport shall include how the monies of the fund were utilized during the\npreceding calendar year, and shall include:\n (i) the amount of money dispersed from the fund and the award process\nused for such disbursements;\n (ii) recipients of awards from the fund;\n (iii) the amount awarded to each recipient;\n (iv) the purposes for which such awards were granted; and\n (v) a summary financial plan for such monies which shall include\nestimates of all receipts and all disbursements for the current and\nsucceeding fiscal years, along with the actual results from the prior\nfiscal year.\n 3. Monies of the fund shall be expended only for leukemia, lymphoma\nand myeloma research, education and treatment projects. As used in this\nsection, "leukemia, lymphoma and myeloma research, education and\ntreatment projects" means research, education and treatment projects,\nincluding grants for leukemia, lymphoma and myeloma research, education\nand treatment, which, pursuant to section twenty-seven hundred\nforty-seven of the public health law, are approved by the department of\nhealth. Such grants may include, among others, grants to public and\nprivate hospitals, medical centers, medical schools and other\norganizations.\n 4. Monies shall be payable from the fund on the audit and warrant of\nthe comptroller on vouchers approved and certified by the commissioner\nof health.\n 5. To the extent practicable, the commissioner of health shall ensure\nthat all monies received during a fiscal year are expended prior to the\nend of that fiscal year.\n * NB There are 2 § 97-ssss's\n
