1.There\nis hereby established in the joint custody of the commissioner of\ntaxation and finance and the comptroller a fund to be known as the\n"sickle cell disease research and education fund".\n 2. On or before the first day of February each year, the comptroller\nshall certify to the governor, temporary president of the senate,\nspeaker of the assembly, chair of the senate finance committee and chair\nof the assembly ways and means committee, the amount of money deposited\nin the sickle cell disease research and education fund during the\npreceding calendar year as the result of revenue derived pursuant to\nsection four hundred four-y of the vehicle and traffic law and from\ngrants, gifts and bequests.\n 2-b. On or before the first day of February each year, the\ncommissioner of health shall provide a written report to the temporary\npresident of the senate, speaker of the assembly, chair of the senate\nfinance committee, chair of the assembly ways and means committee, chair\nof the senate committee on health, chair of the assembly health\ncommittee, the state comptroller and the public. Such report shall\ninclude how the monies of the fund were utilized during the preceding\ncalendar year, and shall include:\n (i) the amount of money disbursed from the fund and the award process\nused for such disbursements;\n (ii) recipients of awards from the fund;\n (iii) the amount awarded to each;\n (iv) the purposes for which such awards were granted; and\n (v) a summary financial plan for such moneys which shall include\nestimates of all receipts and all disbursements for the current and\nsucceeding fiscal years, along with the actual results from the prior\nfiscal year.\n 3. Moneys of the fund shall be expended only for sickle cell disease\nresearch projects and sickle cell disease education projects approved by\nthe department of health in New York state. As used in this section, the\nterm "sickle cell disease research project" means scientific research\napproved by the department of health into the causes and/or treatment of\nsickle cell disease, and the term "sickle cell disease education\nproject" means a project approved by the department of health aimed\ntoward educating the general public about the causes, symptoms, and\ntreatment of sickle cell disease.\n 4. Moneys shall be payable from the fund on the audit and warrant of\nthe comptroller on vouchers approved and certified by the commissioner\nof health.\n 5. To the extent practicable, the commissioner of health shall ensure\nthat all moneys received during a fiscal year are expended prior to the\nend of that fiscal year.\n * NB There are 2 § 97-pppp's\n
