§ 97-g. Centralized services fund. 1. There is hereby established in\nthe custody of the state comptroller a special fund to be known as the\ncentralized services fund.\n 2. (a) Such fund shall consist of all moneys appropriated for the\npurpose of such fund, all moneys transferred to such fund pursuant to\nlaw and all moneys required by the provisions of this section to be paid\nto the credit of such fund.\n (b) The state comptroller is authorized and directed to loan money by\ntransfer to such fund from the general fund or any other fund, which\nloans shall be limited to the amounts immediately required to meet\ndisbursements, made in pursuance of an appropriation by law and\nauthorized by a certificate of approval issued by the director of the\nbudget with copies thereof filed with the comptroller and the chairs of\nthe senate finance committee and assembly ways and means committee. The\ndirector of the budget shall not issue such a certificate unless he\nshall have determined that the amounts to be so transferred are\nreceivable on account or are otherwise readily available for payment.\nWhen making a loan, the comptroller shall establish appropriate accounts\nand if the loan is not repaid by the end of the month, provide on or\nbefore the fifteenth day of the following month to the director of the\nbudget, the chairs of the senate finance committee and assembly ways and\nmeans committee, an accurate accounting and reporting of the financial\nresources of such fund at the end of the month. Within ten days of the\nreceipt of such accounting and reporting, the director of the budget\nshall provide to the chairs of the senate finance committee and assembly\nways and means committee a schedule of expected repayments and the\nsource of such repayment. Repayment shall be made by the comptroller by\ntransfer of the first cash receipts of such fund.\n * 3. Moneys of the fund shall be available to the commissioner of\ngeneral services for the purchase of food, supplies and equipment for\nstate agencies, and for the purpose of furnishing or providing\ncentralized services to or for state agencies; provided further that\nsuch moneys shall be available to the commissioner of general services\nfor purposes pursuant to items (d) and (f) of subdivision four of this\nsection to or for political subdivisions, public authorities, and public\nbenefit corporations. Beginning the first day of April, two thousand\ntwo, moneys in such fund shall also be transferred by the state\ncomptroller to the revenue bond tax fund account of the general debt\nservice fund in amounts equal to those required for payments to\nauthorized issuers for revenue bonds issued pursuant to article five-C\nand article five-F of this chapter for the purpose of lease purchases\nand installment purchases by or for state agencies and institutions for\npersonal or real property purposes.\n * NB Effective until July 31, 2029\n * 3. Moneys of the fund shall be available to the commissioner of\ngeneral services for the purchase of food, supplies and equipment for\nstate institutions and other state agencies, and for the purpose of\nfurnishing or providing centralized services to or for state\ninstitutions and other state agencies, public authorities, and public\nbenfit corporations. Beginning the first day of April, two thousand\ntwo, moneys in such fund shall also be transferred by the state\ncomptroller to the revenue bond tax fund account of the general debt\nservice fund in amounts equal to those required for payments to\nauthorized issuers for revenue bonds issued pursuant to article five-C\nof this chapter for the purpose of lease purchases and installment\npurchases by or for state agencies and institutions for personal or real\nproperty purposes.\n * NB Effective July 31, 2029\n * 4. The term "centralized services" as used in this section shall\nmean and include only (a) communications services, (b) mail, messenger\nand reproduction services, (c) computer services, (d) fuels, including\nnatural gas, hydrogen, biofuels and gasoline, and automotive services,\n(e) renovation and maintenance services, (f) purchases of electricity,\nrenewable energy, renewable energy credits or attributes from the power\nauthority of the state of New York and, in consultation with the power\nauthority of the state of New York, from other suppliers, (g) real\nproperty management services, (h) building design and construction\nservices, (i) parking services, (j) distribution of United States\ndepartment of agriculture donated foods to eligible recipients, pursuant\nto all applicable statutes and regulations, (k) distribution of federal\nsurplus property donations to all eligible recipients, pursuant to\napplicable statutes and regulations, and (l) payments and related\nservices for lease purchases and installment purchases by or for state\nagencies and institutions for personal property purposes financed\nthrough the issuance of certificates of participation. The services\ndefined in items (a) through (c), (e), (g) and (h) of this subdivision\nshall be provided to state agencies and institutions only.\n * NB Effective until July 31, 2029\n * 4. The term "centralized services" as used in this section shall\nmean and include only (a) communications services, (b) mail, messenger\nand reproduction services, (c) computer services, (d) gasoline and\nautomotive services, (e) renovation and maintenance services, (f)\npurchases of electricity from the power authority of the state of New\nYork, (g) real property management services, (h) building design and\nconstruction services, (i) parking services, (j) distribution of United\nStates department of agriculture donated foods to eligible recipients,\npursuant to all applicable statutes and regulations, (k) distribution of\nfederal surplus property donations to all eligible recipients, pursuant\nto applicable statutes and regulations and (l) payments and related\nservices for lease purchases and installment purchases by or for state\nagencies and institutions for personal property purposes financed\nthrough the issuance of certificates of participation. The services\ndefined in items (a) through (c), (e), (g) and (h) of this subdivision\nshall be provided to state agencies and institutions only.\n * NB Effective July 31, 2029\n * 5. The amount expended from such fund for the above-stated purposes\nshall be charged against the agency, political subdivision, public\nauthority or public benefit corporation above receiving such food,\nsupplies, equipment and services and all payments received therefor\nshall be credited to such fund.\n * NB Effective until July 31, 2029\n * 5. Payments from such fund shall be made upon audit and warrant of the\nstate comptroller upon vouchers certified or approved by the\ncommissioner of general services in the manner provided by law.\n 7. If the state comptroller shall find at the expiration of the fiscal\nyear, commencing April first, nineteen hundred sixty-four and at the\nexpiration of each fiscal year thereafter that the total amount to the\ncredit of the fund is in excess of the sum of two million dollars, he\nshall within thirty days thereafter, transfer to the general fund of the\nstate a sum equal to the amount of such excess.\n
