§ 179-u. Advance payments.

1.When a state agency administering a\ncontract shall advise the not-for-profit organization of the agency's\nintention to renew the contract, the not-for-profit organization, may,\nupon receipt of a written directive, be entitled to an advance payment\npending execution of the renewal contract if such contract is not fully\nexecuted by the commencement date of the succeeding contract; the\nwritten directive shall specifically set forth the dollar amount and the\nperiod of time covered by the advance payment. Such advance payment\nshall offset future payments due to the organization for services\nprovided during the term of the prospective renewal contract and shall\nnot exceed the maximum contract amount set forth in said renewal\ncontract.\n 2.
