§ 614. Effect of other laws.
a.Any other provision of this chapter,\nof the education law or of the administrative code of the city of New\nYork, or rules and regulations thereunder, relating to the reemployment\nof retired members, transfer of members and reserves between systems and\nprocedural matters including but not limited to filing requirements,\ntermination of membership, duties of participating employers, and\nactuarial assumptions shall apply to members covered under this article\nduring the duration thereof unless inconsistent herewith, or with rules\nand regulations adopted for the implementation of this article.\n b. Notwithstanding any other provision of law:\n (i) If a person who last became a member of a public retirement system\nof the state before July first, nineteen hundred seventy-three retires,\nsuch person shall, upon reentry to membership in a public retirement\nsystem of the state, be subject to all retirement rights, privileges and\nobligations which would pertain to such person had he reentered\nmembership in such retirement system on June thirtieth, nineteen hundred\nseventy-three.\n (ii) If a person who last became a member of a public retirement\nsystem of the state after June thirtieth, nineteen hundred seventy-three\nbut prior to July first, nineteen hundred seventy-six retires such\nperson shall, upon reentry to membership in a public retirement system\nof the state, be subject to all retirement rights, privileges and\nobligations which would pertain to such person had he reentered\nmembership in such retirement system on June thirtieth, nineteen hundred\nseventy-six.\n (iii) The provisions of this article shall not be construed to repeal,\namend or modify any provisions of law or rules or regulations in effect\non June thirtieth, nineteen hundred seventy-six issued thereunder which\ngovern the reemployment of retired persons by public employers.\n (iv) Notwithstanding any other provision of law, any member of a\npublic retirement system who retired after having last entered such\nsystem prior to July first, nineteen hundred seventy-three, and\nthereafter reentered service and joined or rejoined a public retirement\nsystem prior to April first, nineteen hundred seventy-seven, shall be\nentitled to all the rights, benefits and privileges and subject to all\nthe obligations set forth in any law or laws relating to public\nretirement systems to which he would have been subject or entitled had\nhe reentered membership in such retirement system on June thirtieth,\nnineteen hundred seventy-three.\n (v) Notwithstanding any other provision of law, any member of a public\nretirement system who retired after having last entered such system\nafter June thirtieth, nineteen hundred seventy-three and prior to July\nfirst, nineteen hundred seventy-six and thereafter reentered service and\njoined or rejoined a public retirement system prior to April first,\nnineteen hundred seventy-seven, shall be entitled to all the rights,\nbenefits and privileges and subject to all the obligations set forth in\nany law or laws relating to public retirement systems to which he would\nhave been subject or entitled had he reentered membership in such\nretirement system on June thirtieth, nineteen hundred seventy-six.\n
