§ 104. Transfer of officers and employees. Officers and employees of\nthe transit commission exercising functions and performing service in\nrespect to subject or matters, jurisdiction of which was transferred to\nthe board of transportation, shall be eligible for transfer and\nappointment without examination to offices and positions in the office\nof the board of transportation; and, so far as necessity for such\nservice exists, shall be so transferred and appointed. Officers and\nemployees of the transit commission, having prior to July first,\nnineteen hundred forty exercised functions and having performed services\nin respect to subjects or matters, jurisdiction of which was transferred\nto the board of transportation, shall be eligible to have their records\nof service transferred
