§ 2676-E — Transfer of officers and employees

§ 2676-e. Transfer of officers and employees. 1. In accordance with\nthe provisions of section seventy of the civil service law, any officer\nor employee of the county, may, at the request of the authority and with\nthe consent of the county executive, be transferred to the authority and\nshall be eligible for such transfer and appointment, without further\nexamination, to applicable offices, positions, and employment under the\nauthority. Any such officers or employees so transferred to the\nauthority pursuant to this section, who are members of or benefit under\nany pension or retirement fund or system under the laws of the state,\nshall continue to have all rights, privileges, obligations and status\nwith respect to such fund or system as are prescribed by law, but during\nthe period of their employment by the authority, all contributions to\nsuch funds or systems to be paid by the employer on account of such\nofficers or employees shall be paid by the authority.\n 2. A transferred employee shall remain in the same collective\nbargaining unit as was the case prior to such employee's transfer;\nsuccessor employees to the positions held by such transferred employees\nshall, consistent with the provisions of article fourteen of the civil\nservice law, be included in the same unit as such employee's\npredecessors. Employees serving in positions in newly created titles\nshall be assigned to the same collective bargaining unit as such\nemployees would have been assigned to such unit were such titles created\nprior to the establishment of the authority. Nothing contained in this\ntitle shall be construed (a) to diminish the rights of employees\npursuant to a collective bargaining agreement; or (b) to affect existing\nlaw with respect to an application to the public employment relations\nboard seeking a designation by the board that certain persons are\nmanagerial or confidential.\n
