§ 19.15 Programs of the office of alcoholism and substance abuse\n services.\n (a) With the advice of the advisory council on alcoholism and\nsubstance abuse services, and with the assistance of any\ninterdepartmental council or committee heretofore or hereafter\nestablished that shall be charged with the responsibility for\ninterdepartmental cooperation and program development in alcoholism,\nsubstance abuse, and chemical dependency, the commissioner shall\npromote, establish, coordinate, and conduct programs for prevention,\ndiagnosis, treatment, aftercare, rehabilitation, and control in the\nfields of alcoholism, alcohol abuse, substance abuse, substance\ndependence, and chemical dependence in cooperation with such other\nfederal, state, local, and private agencies as are necessary and, within\nthe amount made available by appropriation therefor, implement and\nadminister such programs.\n (b) The commissioner shall cooperate with, guide, and assist political\nsubdivisions, local agencies, local governmental units, community\nservice boards, and/or providers of services in the development and\nperiodic review of local comprehensive plans and programs for alcoholic,\nalcohol abusing, substance abusing, substance dependent and chemically\ndependent persons and their families and approve such plans and\nprograms.\n (c) The activities described in subdivisions (a) and (b) of this\nsection may be undertaken in cooperation and agreement with other\noffices of the department and with other departments or agencies of the\nstate, local or federal government, or with other organizations and\nindividuals, including, but not limited to, the research institute on\naddictions as established in article one hundred five of the education\nlaw.\n (d) The commissioner shall provide for the development of systems and\nprograms through which individuals in the state's public and private\nwork force who abuse or are dependent on alcohol and/or substances, and\ntheir families or significant others are identified and referred for\nassistance, ensuring that these systems and programs shall provide\nemphasis upon the special needs of working women.\n (e) The commissioner shall implement a program of alcoholism,\nsubstance abuse, and chemical dependence prevention and treatment\nservices adapted to the needs and interests of young people, including\nthe children of alcoholic and/or substance abusing persons.\n (f) Reports. (1) The commissioner shall make an annual report to the\ngovernor and the legislature by March first of each year assessing the\nprogress in implementing the programs and policies contained in this\ntitle and including an accounting of the amounts, sources and uses of\nfunds expended for alcoholism and substance abuse services and for\nprevention and education.\n (2) The office shall on or before the first day of April in each year\nfile a written report with the governor, the temporary president of the\nsenate and the speaker of the assembly summarizing the results of any\nspecial system or program directed at the special needs of women and\nchildren affected by alcoholism, alcohol abuse, substance abuse,\nsubstance dependence, or chemical dependence. Such report shall include\nbut not be limited to a statistical analysis of the effectiveness of\nsuch programs initiated by the office together with suggested\nlegislation deemed necessary or proper for the implementation of new\nprograms or future success and development of existing programs.\n (g) The office shall study, investigate, and recommend to the governor\nand the legislature methods of increasing third party payments for\nprograms treating persons who abuse or are dependent on alcohol and/or\nsubstances, and their families.\n (h) The office shall administer community and school based alcoholism,\nsubstance abuse, and chemical dependence prevention and education\nprograms.\n (i) The commissioner shall develop plans, and cause to be promoted,\nprograms and services related to compulsive gambling education,\nprevention and treatment consistent with section 41.57 of this chapter.\nHe or she shall take all actions that are necessary, desirable, or\nproper to implement the purposes of this chapter and to carry out the\npurposes and objectives of the department within the amounts made\navailable therefor by appropriation, grant, gift, devise, bequest or\nallocation from the problem and compulsive gambling education,\nprevention and treatment fund established under section ninety-nine-i of\nthe state finance law, as amended by section one of part Y of chapter\nsixty-three of the laws of two thousand three.\n
