§ 273. Salary of clerks to justices of supreme court.
1.Each of the\nclerks appointed by the justices of the supreme court in the first\njudicial district, pursuant to subdivision one of section one hundred\nand fifty-seven of this chapter, shall receive as salary a sum to be\nfixed by the justices thereof, or a majority of them, not designated as\njustices of the appellate division.\n 2. Each of the confidential clerks to the justices of the supreme\ncourt in the second judicial district, other than justices of the\nappellate division, shall receive an annual salary, the amount of which\nshall be fixed by a majority of said justices. The money required\nto pay such salaries shall be raised and paid in the same manner\nrequired to pay salaries of attendants and officers of the supreme court\nin said districts.\n 3. Each of the confidential clerks to the justices of the supreme\ncourt in the tenth judicial district, other than justices of the\nappellate division residing in the tenth judicial district, shall\nreceive an annual salary to be fixed by the justices of the supreme\ncourt residing in the tenth judicial district other than justices of the\nappellate division, or a majority of them. Such salaries shall be\naudited by the state comptroller and paid by the state department of\ntaxation and finance in equal monthly payments when certified to such\ncomptroller by the justice who made the appointment or in case of his\ndeath or disability by any other justice of the tenth judicial district.\nThe total amount of such salaries shall be apportioned by such\ndepartment among the counties of Nassau and Suffolk. Such counties shall\nreimburse the state therefor. The time and method of such apportionment\nand the time and method of such reimbursement shall be as specified in\nsection seventy-four of this chapter.\n 4. Each of the confidential clerks to the justices of the supreme\ncourt in the fifth judicial district appointed pursuant to subdivision\nfour of section one hundred fifty-seven of this chapter, shall receive\nan annual salary of three thousand dollars; provided, however, that in\ncase of the appointment by such a justice of both a confidential clerk\nand confidential deputy clerk, such confidential clerk and such deputy\nclerk shall each receive an annual salary to be fixed by the justice\nappointing him, or them, not to exceed in the aggregate for both such\nconfidential clerk and deputy clerk the sum of three thousand dollars.\nEach of such salaries shall be audited by the state comptroller and paid\nby the state department of taxation and finance, in equal monthly\npayments when certified to such comptroller by the justice who made the\nappointment or, in case of his death or disability, by any other justice\nof the fifth judicial district. An appropriation in any year for salary\nof such a confidential clerk, to any such justice, shall be available\nfor payment of the salaries of both the confidential clerk and\nconfidential deputy clerk to the same justice, if such be appointed. The\ntotal amount of such salaries shall be apportioned by such department\namong the counties comprising the fifth judicial district. Such counties\nshall reimburse the state therefor. The time and method of such\napportionment and the time and method of such reimbursement shall be as\nspecified in section seventy-four of this chapter.\n 5. Each of the clerks to the justices of the supreme court in the\nsixth judicial district shall receive an annual salary to be fixed by\nthe justice appointing him, of not to exceed three thousand dollars.\nEach of such salaries shall be audited by the state comptroller and paid\nby the state department of taxation and finance in equal quarterly\npayments when certified to such comptroller by the justice who made the\nappointment or, in case of his death or disability, by any other justice\nof the sixth judicial district. The total amount of such salaries shall\nbe apportioned by such department among the counties comprising the\nsixth judicial district. Such counties shall reimburse the state\ntherefor. The time and method of such apportionment and the time and\nmethod of such reimbursement shall be as specified in section\nseventy-four of this chapter.\n 6. Each of the clerks to the justices of the supreme court in the\nseventh judicial district shall receive an annual salary, to be fixed by\nthe justice appointing him, of not to exceed twenty-five hundred\ndollars, provided, however, that in case of the appointment by such\njustice of both a confidential clerk and one or two confidential deputy\nclerk or clerks, such confidential clerk and such confidential deputy\nclerk or clerks shall each receive an annual salary to be fixed by the\njustice making the appointment, not to exceed in the aggregate for both\nsuch confidential clerk and confidential deputy clerk or clerks the sum\nof twenty-five hundred dollars. Each of such salaries shall be audited\nby the state comptroller and paid by the state department of taxation\nand finance in equal monthly payments when certified to such comptroller\nby the justice who made the appointment or, in case of his death or\ndisability, by any other justice of the seventh judicial district. The\ntotal amount of such salaries shall be apportioned by such department\namong the counties comprising the seventh judicial district. Such\ncounties shall reimburse the state therefor. The time and method of such\napportionment and the time and method of such reimbursement shall be as\nspecified in section seventy-four of this chapter.\n 7. Each of the clerks to the justices of the supreme court in the\neighth judicial district, shall receive an annual salary, to be fixed by\nthe justice appointing him, of not to exceed six thousand dollars. Each\nof such salaries shall be audited by the state comptroller and paid by\nthe state department of taxation and finance in equal monthly payments\nwhen certified to such comptroller by the justice who made the\nappointment or, in case of his death or disability, by any other justice\nof the eighth judicial district. The total amount of such salaries shall\nbe apportioned by such department among the counties comprising the\neighth judicial district. Such counties shall reimburse the state\ntherefor. The time and method of such apportionment and the time and\nmethod of such reimbursement shall be as specified in section\nseventy-four of this chapter.\n 8. Each confidential clerk employed by a justice of the supreme court\nin and for the ninth judicial district, pursuant to the provisions of\nsubdivision eight of section one hundred fifty-seven of this chapter,\nshall receive an annual salary not to exceed the sum of eight thousand\nfive hundred ninety dollars, together with the actual and necessary\nexpenses incurred by him in the performance of his official duties, to\nbe paid upon proper proof thereof, and upon the approval of the justice\nof the supreme court in whose behalf the official duties are rendered.\nThe state comptroller shall audit the salary and expenses of each\nconfidential clerk and the state department of taxation and finance\nshall pay to each confidential clerk his salary, in equal monthly\npayments, and also his expenses when certified to the state comptroller\nby the justice who made the appointment, or if he has died or is\ndisabled, by any other justice of the ninth judicial district. The total\namount of all salaries and expenses of all confidential clerks of the\nninth judicial district shall be apportioned by the department of\ntaxation and finance among the counties of Westchester, Rockland,\nOrange, Dutchess and Putnam which shall reimburse the state therefor,\nand the time and method of apportionment and reimbursement shall be\nthose specified in section seventy-four of this chapter.\n 9. Each of the confidential law clerks to the justices of the supreme\ncourt in the third judicial district shall receive an annual salary to\nbe fixed by the justice appointing him, of not to exceed five thousand\ndollars. Each of such salaries shall be audited by the state comptroller\nand paid by the state department of taxation and finance in equal\nmonthly payments when certified to such comptroller by the justice who\nmade the appointment or, in case of his death or disability, by any\nother justice of the third judicial district. The total amount of such\nsalaries shall be apportioned by such department among the counties\ncomprising the third judicial district. Such counties shall reimburse\nthe state therefor. The time and method of such apportionment and the\ntime and method of such reimbursement shall be as specified in section\nseventy-four of this chapter.\n 10. Each of the confidential law clerks to the justices of the supreme\ncourt in the fourth judicial district shall receive an annual salary to\nbe fixed by the justice appointing him, of not to exceed five thousand\ndollars. Each of such salaries shall be audited by the state comptroller\nand paid by the state department of taxation and finance in equal\nmonthly payments when certified to such comptroller by the justice who\nmade the appointment or, in case of his death or disability, by any\nother justice of the fourth judicial district. The total amount of such\nsalaries shall be apportioned by such department among the counties\ncomprising the fourth judicial district. Such counties shall reimburse\nthe state therefor. The time and method of such apportionment and the\ntime and method of such reimbursement shall be as specified in section\nseventy-four of this chapter.\n
