§ 905. Disclosures. * 1. Each peer-to-peer car sharing program\nagreement made in this state shall disclose and separately state or\nitemize to the shared vehicle owner and the shared vehicle driver:\n (a) the daily rate, fees, and, if applicable, any insurance or\nprotection package costs that shall be charged to the shared vehicle\nowner or the shared vehicle driver; and\n (b) an emergency telephone number to contact personnel capable of\nproviding roadside assistance and handling other customer service\ninquiries.\n * NB Effective until June 17, 2026\n * 1. Each peer-to-peer car sharing program agreement made in this\nstate shall disclose and separately state or itemize to the shared\nvehicle owner and the shared vehicle driver:\n (a) the daily rate, fees, and, if applicable, any insurance or\nprotection package costs that shall be charged to the shared vehicle\nowner or the shared vehicle driver;\n (b) an emergency telephone number to contact personnel capable of\nproviding roadside assistance and handling other customer service\ninquiries;\n (c) the coverage, limits, and exclusions that the group policy\nprovides;\n (d) a description of the additional insurance coverages that the\npeer-to-peer car sharing program administrator provides or offers\npursuant to section two thousand one hundred thirty-one of the insurance\nlaw;\n (e) a statement that for each peer-to-peer car sharing period, a\npeer-to-peer car sharing program administrator must either provide\nadditional liability insurance or offer the shared vehicle owner and\nshared vehicle driver with the opportunity to purchase additional\nliability insurance pursuant to subparagraph (A) of paragraph one of\nsubsection (d) of section two thousand one hundred thirty-one of the\ninsurance law; and\n (f) a statement describing any additional insurance that a\npeer-to-peer car sharing administrator may provide a shared vehicle\nowner or a shared vehicle driver with the opportunity to purchase\npursuant to section two thousand one hundred thirty-one of the insurance\nlaw.\n * NB Effective June 17, 2026\n 2. No peer-to-peer car sharing program administrator shall accept a\nreservation unless the shared vehicle driver has received a final quoted\nrate that includes all charges which the shared vehicle driver shall pay\nto obtain access to the vehicle, provided, however, that a peer-to-peer\ncar sharing program administrator may separately state itemized optional\nitems and/or services or any mileage below the final quoted rate in the\nsame font and on the same page or webpage on which the rate quote is\nprovided.\n
