§ 1102. Terms of service report.
1.On a semiannual basis in\naccordance with subdivision two of this section, a social media company\nshall submit to the attorney general a terms of service report. The\nterms of service report shall include, for each social media platform\nowned or operated by the company, all of the following:\n (a) The current version of the terms of service of the social media\nplatform.\n (b) If a social media company has filed its first report, a complete\nand detailed description of any changes to the terms of service since\nthe previous report.\n (c) A statement of whether the current version of the terms of service\ndefines each of the following categories of content, and, if so, the\ndefinitions of those categories, including any subcategories:\n (i) hate s

§ 1102. Terms of service report. 1. On a semiannual basis in\naccordance with subdivision two of this section, a social media company\nshall submit to the attorney general a terms of service report. The\nterms of service report shall include, for each social media platform\nowned or operated by the company, all of the following:\n (a) The current version of the terms of service of the social media\nplatform.\n (b) If a social media company has filed its first report, a complete\nand detailed description of any changes to the terms of service since\nthe previous report.\n (c) A statement of whether the current version of the terms of service\ndefines each of the following categories of content, and, if so, the\ndefinitions of those categories, including any subcategories:\n (i) hate speech or racism;\n (ii) extremism or radicalization;\n (iii) disinformation or misinformation;\n (iv) harassment; and/or\n (v) foreign political interference.\n (d) A detailed description of content moderation practices used by the\nsocial media company for that platform, including, but not limited to,\nall of the following:\n (i) any existing policies intended to address the categories of\ncontent described in paragraph (c) of this subdivision;\n (ii) how automated content moderation systems enforce terms of service\nof the social media platform and when these systems involve human\nreview;\n (iii) how the social media company responds to user reports of\nviolations of the terms of service;\n (iv) how the social media company would remove individual pieces of\ncontent, users, or groups that violate the terms of service, or take\nbroader action against individual users or against groups of users that\nviolate the terms of service; and\n (v) the languages in which the social media platform does not make\nterms of service available, but does offer product features, including,\nbut not limited to, menus and prompts.\n (e) (i) Information on content that was flagged by the social media\ncompany as content belonging to any of the categories described in\nparagraph (c) of this subdivision, including all of the following:\n (A) the total number of flagged items of content;\n (B) the total number of actioned items of content;\n (C) the total number of actioned items of content that resulted in\naction taken by the social media company against the user or group of\nusers responsible for the content;\n (D) the total number of actioned items of content that were removed,\ndemonetized, or deprioritized by the social media company;\n (E) the number of times actioned items of content were viewed or heard\nby users;\n (F) the number of times actioned items of content were shared, and the\nnumber of users that viewed or heard the content before it was actioned;\nand\n (G) the number of times users appealed social media company actions\ntaken on that platform and the number of reversals of social media\ncompany actions on appeal disaggregated by each type of action.\n (ii) All information required by subparagraph (i) of this paragraph\nshall be disaggregated into the following categories:\n (A) the category of content, including any relevant categories\ndescribed in paragraph (c) of this subdivision;\n (B) the type of content, including, but not limited to, posts,\nlivestreams, comments, messages, profiles of users, or groups of users;\n (C) the type of media of the content, including, but not limited to,\ntext, images, livestreams, and videos;\n (D) how the content was flagged, including, but not limited to,\nflagged by company employees or contractors, flagged by artificial\nintelligence software, flagged by community moderators, flagged by civil\nsociety partners, and flagged by users; and\n (E) how the content was actioned, including, but not limited to,\nactioned by company employees or contractors, actioned by artificial\nintelligence software, actioned by community moderators, actioned by\ncivil society partners, and actioned by users.\n 2. (a) A social media company shall electronically submit a semiannual\nterms of service report pursuant to subdivision one of this section,\ncovering activity within the third and fourth quarters of the preceding\ncalendar year, to the attorney general no later than April first of each\nyear, and shall electronically submit a semiannual terms of service\nreport pursuant to subdivision one of this section, covering activity\nwithin the first and second quarters of the current calendar year, to\nthe attorney general no later than October first of each year.\n (b) Notwithstanding paragraph (a) of this subdivision, a social media\ncompany shall electronically submit its first terms of service report\npursuant to subdivision one of this section, covering activity within\nthe third quarter of two thousand twenty-five, to the attorney general\nno later than January first, two thousand twenty-six, and shall\nelectronically submit its second terms of service report pursuant to\nsubdivision one of this section, covering activity within the fourth\nquarter of two thousand twenty-five, to the attorney general no later\nthan April first, two thousand twenty-six. A social media platform shall\nsubmit its third report no later than October first, two thousand\ntwenty-six, in accordance with paragraph (a) of this subdivision.\n 3. The attorney general shall make all terms of service reports\nsubmitted pursuant to this section available to the public in a\nsearchable repository on its official internet website.\n
