§ 39-0107. Powers and duties of the commissioner.\n 1. The commissioner shall, within three calendar months after the\neffective date of this article, promulgate regulations establishing\nmethods for indentification and quantification of ingredients in sewage\nsystem cleaners and additives used in restricted geographical areas.\n 2. The commissioner shall, within three calendar months after the\neffective date of this article, promulgate regulations requiring\nmanufacturers of sewage system cleaners or additives distributed, sold\nor offered for sale in restricted geographical areas to furnish to the\ncommissioner existing information regarding chemical components\nincluding the nature and extent of investigations and research performed\nby the manufacturer concerning the effects of such products on the\nquality of groundwaters, provided, however, that in lieu of furnishing\nsaid information, such manufacturers may refer the commissioner to any\nfederal or state agency which has obtained said information, to the\nextent that said information is available to the commissioner from any\nsuch agency.\n 3. Whenever the commissioner finds, after investigation and public\nhearing, that any ingredient other than a restricted chemical material\nin a sewage system cleaner or additive distributed, sold, offered or\nexposed for sale in restricted geographical areas is likely to have a\ndangerous, deleterious or injurious effect upon the public health or\nenvironment, he shall prohibit or restrict in restricted geographical\nareas the sale, distribution, offer or exposure for sale or use by any\nperson of sewage system cleaners or additives containing such\ningredients.\n 4. The commissioner shall hold confidential any information obtained\npursuant to subdivision two of this section when shown by any\nmanufacturer that such information, if made public, would divulge\ncompetitive business information, methods or processes entitled to\nprotection as trade secrets of such manufacturers.\n
