§ 37-0905. Chemicals of concern and high-priority chemicals.\n 1. Chemicals of concern.\n (a) Within two years of the effective date of this title, the\ndepartment, in consultation with the department of health, shall\npromulgate a list of chemicals of concern. The department may remove a chemical\nfrom the list of chemicals of concern if, upon review, it determines on\nthe basis of credible scientific evidence that such chemical no longer\nmeets the criteria for listing under paragraph (a) of this subdivision.\n 2. High-priority chemicals. (a) The following chemicals are designated\nhigh priority chemicals for purposes of this title:\n (i) Tris (1, 3 dichloro-2-propyl) phosphate (CAS 13674-87-8)\n (ii) Benzene (CAS 71-43-2)\n (iii) Mercury and mercury compounds, including methyl mercury (CAS\n7439-97-6)\n (iv) Asbestos (CAS 1332-21-4)\n (v) Arsenic and arsenic compounds (CAS 7440-38-2) including arsenic\ntrioxide (CASRN 1327-53-3) and dimethyl arsenic (CASRN 75-60-5)\n (vi) Cadmium (CAS 7440-43-9) (other than toy coatings)\n (vii) Organohalogen flame retardants in upholstered bedding or\nfurniture\n (b) The department shall periodically review the list of high priority\nchemicals and may by rule add to the list of high-priority chemicals if\nthe criteria of paragraph (a) of subdivision one of this section are met\nand the chemical is present in a children's product and meets any of the\nfollowing criteria:\n (i) The chemical or its metabolites have been found through\nbiomonitoring to be present in humans;\n (ii) The chemical has been found through sampling and analysis to be\npresent in household dust, indoor air, drinking water or elsewhere in\nthe home environment;\n (iii) The chemical has been found through monitoring to be present in\nfish, wildlife or the natural environment; or\n (iv) The sale or use of the chemical or a children's product\ncontaining the chemical has been banned in another state or states\nwithin the United States because of the health effects of such chemical\nor the children's product safety council established pursuant to section\n37-0911 of this title has recommended the chemical be listed as a\nhigh-priority chemical. The department shall, as part of its periodic\nreview, consider whether the sale or use of a chemical or a children's\nproduct containing the chemical has been banned in another state or\nwithin the United States because of the health effects of such chemical.\n (c) The department, in consultation with the department of health, may\nremove a chemical from the list of high priority chemicals if it\ndetermines on the basis of credible scientific evidence that such\nchemical no longer meets the criteria of paragraph (b) of this\nsubdivision.\n
