§ 11-1201 — Definitions

§ 11-1201. Definitions.\n For the purposes of this title:\n 1. "Hunting" means shooting or killing wildlife, including shooting or\nkilling wildlife lawfully trapped or otherwise reduced to possession, or\npursuing or capturing wildlife with any weapon, projectile, or other\ndevice or instrumentality; and includes all lesser acts such as\ndisturbing, harrying, or worrying, whether they result in taking or not,\nwhen done with the aid or accompaniment of any weapon, projectile, or\nother device or instrumentality; and every attempt to take and every act\nof assistance to any other person in taking or attempting to take\nwildlife, when done with the aid or accompaniment of any weapon,\nprojectile, or other device or instrumentality. "Wildlife" as used in\nthis subdivision means "wildlife" as that term is defined in subdivision\nsix of section 11-0103 of the environmental conservation law.\n 2. "Intoxicated condition" shall mean the presence of .08 of one per\ncentum or more by weight of alcohol in a person's blood as shown by\nchemical analyses of his blood, breath, urine, or saliva made pursuant\nto section 11-1205 of this title. An "impaired condition" shall mean a\nstate of impairment of a person's capacity to think or act correctly, or\nof a loss, even in part of a person's control of his physical or mental\nfaculties due to his consumption of alcohol or use of a drug.\n 3. "Drug" means "drug" as that term is defined in section one hundred\nfourteen-a of the vehicle and traffic law.\n 4. "License to hunt", or "permit to hunt" means any license, permit,\nor other privilege granted pursuant to section 11-0701 of this article\nwhich authorizes the holder to hunt wildlife.\n
