§ 11-0702. Lifetime hunting, fishing, trapping, archery and\n muzzle-loading licenses.\n 1. There are hereby created the following lifetime hunting, fishing,\ntrapping, archery and muzzle-loading privileges and fees therefor\nsubject to the same privileges and obligations of a comparable short\nterm license:\n Licenses Fees\n a. Lifetime license including a\n hunting license, fishing license\n and turkey permit. There are hereby created the following lifetime hunting, fishing,\ntrapping, archery and muzzle-loading privileges and fees therefor\nsubject to the same privileges and obligations of a comparable short\nterm license:\n Licenses Fees\n a. For transfer to a person pursuant\n to section 11-0704 of this title $50.00\n The holder of a lifetime hunting license or lifetime fishing license\nmay, at any time, convert such license to a lifetime license pursuant to\nparagraph a of this subdivision for an additional fee equal to the\ndifference between the current fee for the new license and the fee\noriginally paid for the license.\n 2. Legal residency within the state of New York shall be a\nprerequisite for persons to obtain, or have obtained for them, any\nlifetime licenses included within this section. Lifetime licenses so\nobtained shall continue to be valid for use within the state by the\nperson to whom the lifetime license was issued, regardless of a change\nin residency of that lifetime license holder. Holders of lifetime\nhunting licenses who become non-residents of the state may continue to\nobtain resident bowhunting and muzzle-loading privileges, including\nlifetime archery and muzzle-loading privileges. Holders of lifetime\nbowhunting and muzzle-loading privileges who become non-residents of the\nstate may continue to obtain resident hunting privileges, including any\nlifetime licenses that include any hunting privileges. Possession of\nlifetime licenses is nontransferable.\n 3. Notwithstanding any other provision of law, the commissioner shall\npromulgate rules and regulations, which the department deems necessary\nto implement the establishment of lifetime licenses.\n Such rules and regulations shall provide:\n a. for a permanent, counterfeit-resistant identification card with the\nnecessary identification information;\n b. for annual issuance of necessary tags;\n c. (i) for the replacement of a lost license upon application with a\nnotarized affidavit and a fee of five dollars and (ii) for gift\ninscriptions, up to twenty-three characters, on lifetime licenses for an\nadditional fee of five dollars;\n d. that conditions for lifetime licenses shall include compliance with\nall conditions presently required for holders of short term licenses;\n e. that lifetime license fees shall be increased only when short term\nor annual licenses are increased and shall be increased at the same\npercentage level and that such increases shall not be retroactive.\n 4. All moneys collected from the sale of lifetime licenses shall be\ndeposited in the state fish and game trust account pursuant to section\neighty-three of the state finance law.\n
