§ 249. Participating provider pharmacies.

1.The state shall offer an\nopportunity to participate in this program to all provider pharmacies as\ndefined in section two hundred forty-one of this title, provided,\nhowever, that the participation of pharmacies registered in the state\npursuant to section sixty-eight hundred eight-b of the education law\nshall be limited to state assistance provided under this title for\nprescription drugs covered by a program participant's medicare drug\nplan.\n 2. To participate in this program, a pharmacy shall be required to\nenter into a provider agreement and shall abide by such terms and\nconditions as shall be prescribed in the agreement, including the\nrelease of financial information for the purpose of program audits and\nsurveys.\n
