§ 501. Definitions. As used in this article, the following terms shall\nhave the following meanings:\n 1. "Approved provider" means an entity approved by the commissioner\nthat may provide eligible training to employees of a business entity\nparticipating in the semiconductor manufacturing workforce training\nincentive program. Such criteria shall ensure that any approved provider\npossesses adequate credentials to provide the training described in an\napplication by a business entity to the commissioner to participate in\nthe semiconductor manufacturing workforce training incentive program.\n 2. "Eligible training" means training provided to an employee hired\nwithin twelve months of the business entity applying for this program by\nthe business entity or an approved provider that is:

§ 501. Definitions. As used in this article, the following terms shall\nhave the following meanings:\n 1. "Eligible training" means training provided to an employee hired\nwithin twelve months of the business entity applying for this program by\nthe business entity or an approved provider that is:\n (a) to upgrade, retrain or improve the productivity of employees;\n (b) determined by the commissioner to satisfy a business need on the\npart of a participating business entity;\n (c) not designed to train or upgrade skills as required by a federal\nor state entity; and\n (d) structured to result in measurable advancements in skills and\ncompetencies that will contribute to opportunities for advancement for\nemployees who complete the training.\n 3. "Manufacturing business" means a business that is engaged in the\nprocess of working raw materials into products suitable for use or which\ngives new shapes, new quality or new combinations to matter which has\nalready gone through some artificial process by the use of machinery,\ntools, appliances, or other similar equipment. "Manufacturing" does not\ninclude an operation that involves only the assembly of components,\nprovided, however, that the assembly of motor vehicles or other high\nvalue-added products shall be considered manufacturing.\n 4. "Semiconductor manufacturing business" means a business deemed by\nthe commissioner to make products or develop technologies that are\nprimarily aimed at supporting the growth of the semiconductor\nmanufacturing and related equipment and material supplier sector. This\nshall include, but need not be limited to, semiconductor device\nmanufacturing, producers of component parts, direct input materials and\nequipment necessary for the manufacture of semiconductor chips,\nmachinery, equipment, and materials necessary for the operational\nefficiency of semiconductor manufacturing facilities, other such inputs\ndirectly supportive of the domestic production of semiconductor chips,\nand companies engaged in the assembly, testing, packaging and advanced\npackaging semiconductor value chain. The "semiconductor and supply\nchain" tier shall not include a project primarily composed of: (a)\nmachinery, equipment, or materials that are inputs to manufacturing\ngenerally, but are not direct inputs to semiconductor manufacturing in\nspecific; or (b) the production of products or development of\ntechnologies that would produce only marginal and incremental benefits\nto the semiconductor manufacturing sector.\n 5. "Wrap around services" means transportation, childcare, case\nmanagement and other services designed to maximize the economic impact\nof workforce development training for participants, and to provide the\nsupport services necessary to ensure trainees can access training.\n
