* § 442. Eligibility criteria. In order to participate in the employee\ntraining incentive program, a business entity must satisfy the following\ncriteria:\n 1.

(a)The business entity must operate in the state predominantly in\na strategic industry;\n (b) The business entity must demonstrate that it is conducting\neligible training or obtaining eligible training from an approved\nprovider;\n (c) The business entity must make a significant capital investment in\nconnection with the eligible training; and\n (d) The business entity must be in compliance with all worker\nprotection and environmental laws and regulations. In addition, the\nbusiness entity may not owe past due state taxes or local property\ntaxes; or\n 2.
