§ 440. Prohibition of anti-competitive behavior. A sponsoring campus,\nuniversity or college shall not accept any application to locate in a\ntax-free NY area under subdivision one of section four hundred\nthirty-six of this article from a business that would compete with other\nbusinesses in the same community but outside the tax-free NY area, and\nthe commissioner shall reject any application under subdivision two of\nsection four hundred thirty-six of this article upon determining that\nthe business would compete with other businesses in the same community\nbut outside the tax-free NY area. The commissioner shall issue and\npromulgate such rules and regulations as are necessary to implement this\nsection.\n
